SFC and ICAC jointly investigate suspected misconduct in public office

The Securities and Futures Commission (SFC) today confirmed that a former staff member is one of the three individuals in a case of suspected misconduct in public office brought by the Independent Commission Against Corruption (ICAC) as a result of a joint investigation which is still underway. The other two defendants are a senior government counsel of the Department of Justice and a registered nurse of the Hospital Authority.
The joint investigation followed the SFC’s own internal probe as soon as suspicion of obtaining and misusing of confidential information came to its attention. The employment of the former staff was terminated, and the matter was referred to the ICAC.
The SFC’s investigation showed that the former staff acted on his own with two other individuals and is looking into potential violations under the Securities and Futures Ordinance.
The SFC upholds the highest standard of integrity and takes any misconduct seriously. It conducted a thorough review of its internal policies regarding the handling of confidential information and conflict of interest. Staff have been reminded of their obligations under the SFC staff Code of Conduct in relation to the duties of confidentiality and avoiding conflict of interest. A number of initiatives including reconfirmation of document security classification and awareness promotion of document security classification and shared storage are also in place.
As investigations are ongoing, the SFC will not be able to comment on the case any further.
