ATAL and its staff having settled with the Commission, the court orders disclosure to the other defendants "warts and all" of the correspondence that led to the settlement, as it is "relevant to assessing the veracity of any such information - which is currently being deployed by the Commission". The court also rules that the penalty payable by ATAL should be determined after the trial of the other defendants is over (or they have settled). So the HK$150m to which ATAL and the Commission have agreed (assuming the court eventually approves it) will not be paid yet.

Its accounts at UK Companies House show turnover of GBP12.31m in the year to 30-Sep-2022 and net assets of GBP1.4m. The Commission proposes excluding the human defendants and the directors of the corporate defendants from the "confidentiality ring" for evidence. The court calls this "unsustainable" and remarks that individuals clearly need the information "in order to defend themselves against serious allegations of misconduct" and similarly, "A company makes important decisions about its affairs by resolutions passed by its board; it cannot do so if some directors are deprived of relevant information."
