The Commission proposes excluding the human defendants and the directors of the corporate defendants from the "confidentiality ring" for evidence. The court calls this "unsustainable" and remarks that individuals clearly need the information "in order to defend themselves against serious allegations of misconduct" and similarly, "A company makes important decisions about its affairs by resolutions passed by its board; it cannot do so if some directors are deprived of relevant information."
