Meyer is sued for payment for diesel oil, and in its defence it claims that Taching and Shell HK Ltd colluded in price-fixing in breach of the Competition Ordinance (CO). The Court of First Instance transferred that allegation to the Competition Tribunal, making it the first such action. However, when the Tribunal has made its finding, it will be transferred back to the CFI, because the CO doesn't allow private enforcement, only follow-on actions.
