Once again the MMT has, wrongly in our view, fined a listed company for the failures of its directors, thereby punishing the shareholders from whom information was withheld. The MMT writes that the company's "culpability was its failure to have in place policies and guidelines" - but that is, of course, a failure of the directors to put those in place.

This was on the second attempt, after an earlier tribunal in 2017 (with a different Chairman and the same 2 lay-members) was found by the Court of Appeal to have erred in law. The previous Chairman, Kenneth Kwok Hing Wai, became too ill to proceed with the remitted hearing. The events date back to 2012.

Over a long Easter and Ching Ming 2015 weekend and without forewarning, on Easter Monday, HKEX sent out random stock data as part of a system test, and I-Access, which had not disconnected its feed, took the data and triggered stop-loss orders when the market reopened on the Wednesday. Incidentally, 2 data providers, Bloomberg and AA Stocks, also took the bad data.

Mr Chan is awarded the costs of his 2nd trial (to the extent of his contribution to legal aid) and his successful appeal. He had already spent about HK$4m on his first trial.

Following the second trial, Mr Chan's conviction for murder is again quashed, this time because, although he admitted the killing, Judge Anthea Pang Po Kam failed to direct the jury on the partial defence of provocation and the alternative verdict of manslaughter. A retrial is ordered.

Mr Chan's 2015 conviction is quashed due to a jury misdirection by Deputy High Court Judge Michael Stuart-Moore (who was a Court of Appeal Vice President until retirement in 2009), and a retrial is ordered.
